Terms & Conditions

General

  1. The provisions of this document apply equally to all genders, and the use of the masculine form is for convenience only.

  2. This website is intended to provide public information in the field of education in which the Inclu – Special for Everyone association (hereinafter: "Inclu" or "the Association") operates. The site is used to present the activities of the association, which supports and advises schools, and to showcase relevant activities by schools, including staff members and students. It will also be used to display students' creations and photos related to the association's educational initiatives.

  3. Using the website constitutes acceptance of all the terms of use listed here. If you do not agree with these terms, you must refrain from using the website.

  4. The association may modify these terms, including the way services are operated on the site, at its sole discretion and from time to time.

  5. The association is entitled to suspend or permanently terminate activities on the site, in whole or in part, at any time, and users hereby waive any claims in this regard.

  6. The association may determine, modify, or remove information, content, and images from the site, in whole or in part, at its sole discretion.

  7. These terms and conditions define the legal relationship between the user and the website and indicate the user's agreement to these terms and any additional terms that may appear on the website.

  8. These terms apply to access via any computer or communication device (e.g., mobile phones, tablets, etc.) and apply whether the site is accessed via the internet or any other network or communication means.

Content, Images, and Creations

  1. The content uploaded to the association’s website is the intellectual property of the association. In cases where the content was created by third parties, their consent was obtained for its use, and they waive any claims related to it.

  2. Some of the content consists of works created by children, whose parents have given consent for publication and declared that these are original works that do not infringe upon any third-party property rights.

  3. Some content includes photos of children taken as part of educational activities. The association is sensitive to privacy and legal requirements and will only upload photos for which parental consent was granted.

  4. If a user believes any content on the site infringes upon property rights or privacy, they may contact the association and request its removal. The association will review the request and, if justified, will remove the content accordingly.

Privacy

  1. During use of the site, general statistical data about your activity (e.g., pages visited, time spent on the site, etc.) may be collected. This data is of a general nature and may be retained and used by the association as permitted by law.

  2. If you contact the association via the site, the information you provide may be stored for the purpose of handling your request or maintaining communication, and to improve services offered by the association.

  3. Information about your use of the site may be gathered and stored, and the site management may use this information, or the data you provide upon joining the site, in accordance with these terms of use and the privacy policy, or any applicable law, for purposes such as:

    1. Enabling the use of various services on the site.

    2. Improving and enriching the services and content offered on the site, including creating new content or services suited to users’ needs.

    3. Creating personal areas on the site or in a future app developed by the association.

    4. Contacting you if necessary, or conducting statistical analysis.

    5. Any other purpose stated in the terms of use, this privacy policy, or any other binding policy.

  4. Notwithstanding the above, the association may disclose a user’s personal information to a third party in cases where:

    1. The user acted in a way that harms or may harm the association or any third party.

    2. The user used the association's services to commit an unlawful act.

    3. A court order requires the association to provide such information.

    4. In any legal dispute or proceeding.

  5. The association and/or site management may occasionally send you information about services and educational activities by email. You may opt out of these communications at any time.

  6. Since the internet is an open environment, the association cannot guarantee complete immunity against unauthorized access or hacking. If a third party manages to access or misuse stored information, users shall have no claim or demand against the association.

  7. The association may use cookies to provide faster and more efficient service and to monitor website traffic for optimization and occasional targeted advertising based on users’ previous visits.

  8. You may unsubscribe from direct mail and/or advertising at any time by contacting the association via email at Inclu@inclu.org.il or by phone at 053-733-3391.

Copyrights

  1. All intellectual property rights, including patents, copyrights, designs, and trade secrets, belong solely to the association or to third parties who have permitted their use.

  2. These rights apply to site data, all published content, and any elements related to site operations.

  3. They also apply to the site’s name and domain (www.inclu.com), and all trademarks, whether registered or not, are the property of the association. No use may be made of them without prior written permission.

  4. It is prohibited to link to content from the website that is not the homepage (deep linking) or to display or publish such content in any way, unless the deep link leads to the full and exact webpage on the site, allowing it to be viewed and used in exactly the same manner as it appears on the website, and only with the prior approval of the site’s management.

  5. Site management may revoke deep link permissions at its discretion, and users will have no claim against such a decision.

  6. No part of the site’s content may be copied, used, or allowed for use in other online or print publications without permission.

Sanctions

  1. Without limiting any legal rights, the association may prevent a user from accessing the site, temporarily or permanently, at its discretion and without prior notice, including (but not limited to) the following cases:

    1. Violation of the law or legal regulations;

    2. Violation of these terms;

    3. Any action that disrupts site operation or affects a third party.

Liability

  1. The association (or anyone on its behalf) shall not be held directly or indirectly liable for any damages resulting from use or reliance on content published by third parties (such as schools) or on linked external websites.

  2. The association is also not responsible, directly or indirectly, for any damages related to the use or performance of the site.

  3. In any case, the association will not be liable for any activity not under its full control.

  4. If circumstances beyond the association’s control occur (force majeure), it will not be liable for any direct or indirect damages caused to the user.

Governing Law

  1. The laws applicable to these terms and to any disputes arising from them are solely the laws of the State of Israel.

  2. In case of any dispute, the exclusive jurisdiction shall be with the courts (Magistrate or District) in the Tel Aviv District.
